When Is a Chapter 13 Bankruptcy the Right Decision?

Most people who file for bankruptcy proceed under Chapter 7. But if your income is too high to qualify for Chapter 7 debt relief, or if you have assets which you would lose in a Chapter 7 Bankruptcy, a reorganization of your debts in a Chapter 13 bankruptcy may still be a viable option. Often people use a chapter 13 proceeding to save their home from foreclosure. The Chapter 13 bankruptcy allows you to save your house from foreclosure by letting you bring the past-due payments current over a reasonable period of time.  If you are behind on your house payments, Chapter 13 may give you the ability to get current on the payments, as long as you have a steady source of income to use in calculating a reasonable monthly payment.

Of course, there are usually other concerns besides keeping your house. What about other debts, such as car loans, second mortgages, and tax debt? Our experienced bankruptcy attorneys can guide you toward the development of a repayment plan for debts that the law does not allow to be discharged.
